Introduction
These Terms of Service ("Terms") govern your use of services provided by Wilsaw ("we," "our," or "us"). By engaging our services, you agree to be bound by these Terms.
Services
Wilsaw provides professional tree care services, including but not limited to:
- Tree removal
- Tree trimming and pruning
- Stump grinding
- Emergency tree services
- Tree health assessment
- Commercial tree services
Estimates and Quotes
All quotes are provided free of charge and are valid for 30 days unless otherwise specified. Quotes are based on information available at the time of assessment. Final pricing may vary if site conditions differ from initial assessment or if additional work is required.
Scheduling and Cancellation
Scheduling: Services are scheduled based on availability. Weather conditions and emergency services may affect scheduled appointments.
Cancellation: Customers may cancel or reschedule appointments with at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee.
Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. We accept:
- Cash
- Check
- Credit/Debit cards
- E-transfer
Late payments may be subject to interest charges at a rate of 2% per month or the maximum allowed by law, whichever is less.
Property Access and Preparation
Customers must provide:
- Clear access to work areas
- Information about underground utilities, septic systems, or irrigation
- Notification of any hazards or special conditions
- Permission to access neighboring properties if required
Permits and Compliance
Customers are responsible for obtaining any necessary permits or approvals required by local municipalities. We can provide guidance on permit requirements but cannot guarantee permit approval.
Liability and Insurance
Wilsaw carries comprehensive liability insurance and workers' compensation coverage. We are not responsible for damage to underground utilities, septic systems, or irrigation systems that were not marked or disclosed prior to work. Proof of insurance is available upon request.
Limitations of Liability
To the fullest extent permitted by law:
- We are not liable for damage caused by acts of nature, hidden defects, or pre-existing conditions
- Our liability is limited to the amount paid for the specific service in question
- We are not liable for consequential, indirect, or incidental damages
- Claims must be made within 30 days of service completion
Wood and Debris Disposal
Unless otherwise agreed, wood chips and debris will be removed from the property. Firewood can be left on-site at customer request. Additional fees may apply for disposal of large quantities of wood.
Emergency Services
Emergency services are provided on a first-come, first-served basis. Emergency rates may apply for services requested outside normal business hours. We will make reasonable efforts to respond promptly but cannot guarantee specific response times.
Warranty
We warrant that all services will be performed in a professional manner consistent with industry standards. We do not warranty against tree death, disease, or storm damage occurring after service completion, as these factors are beyond our control.
Disputes and Resolution
In the event of a dispute, both parties agree to first attempt resolution through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with Ontario law.
Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
